General Terms and Conditions of Participation in the Company's Contest
RBV Birkmann GmbH & CO.KG ("Organizer") and the participating customer ("Participant")
- Subject: Terms and Conditions of Participation and Organizer
These conditions of participation regulate the terms for participating in competitions of the organizer as well as any necessary transfer of rights. The descriptions and the procedures of the respective competitions are contained within the framework of the particular competition campaign on the homepage of the organizer www.birkmann.de.( Or iRd conditions of participation, cf. section 2)
The organizer of the competitions is RBV Birkmann GmbH & CO. KG, Hegelstrasse 15, 33790 Halle / Westphalia.
By participating in a specific competition, these terms and conditions of participation are accepted.
- Participation
Participation in competitions of the organizer is free of charge and is governed exclusively by these conditions of participation.
In order to participate in competitions, it is necessary to fill out and send in the participation form or participate via the Internet.
Participation is only possible within the participation period. Entries received after the closing date will not be considered for the draw.
- Eligibility
Eligible to participate are citizens, who are resident in Germany and over the age of 18. Participation is not limited to customers of the organizer and is not dependent on the purchase of goods or services.
If a participant is restricted due to their legal capacity, the consent of a legal representative is required.
All persons and employees of the organizer and affiliated companies involved in the creation and implementation of the competitions as well as the relatives of such employees and their relatives are not eligible to take part in competitions.
Participation with false identities or with identities of third parties is not permitted.
Only one submitted registration per participant will be accepted in competitions. It is strictly forbidden to use multiple addresses or profiles to increase the chances of winning.
In addition, the organizer reserves the right, at its discretion, to exclude persons from participation if there are justified reasons. Such reasons exist in particular in the case of:
- Manipulations in connection with access to or implementation of the competition
- Violations of these conditions of participation
- unfair dealing, or
- false or misleading information in connection with participation in the competitions.
If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.
- Prizes, Notification of Prizes and Transmission of Prizes
The winners will be determined within one week after the closing date as part of a random draw among all participants. If the competition is linked to a task, only those participants who have completed the task correctly will be entered into the raffle.
The participants who are winners of the raffle will be informed promptly about the prize via a separate e-mail or a cover letter.
The prize will only be handed over to the participant who has won or to the legal representative of a participating minor. An exchange, transfer, self-collection or cash payment of the prize is not possible.
Any costs incurred for the dispatch of the prizes will be borne by the organizer.
At the point when the prize is handed over to a transporter, the risk is transferred to the participant. The organizer is not responsible for transit damage.
Additional costs associated with claiming the prize shall be borne by the participant who has won. The participant who has won is responsible for any taxation due on the prize.
If the participant who has won does not respond within a period of 3 weeks after being asked to do so twice, the claim to the prize expires. In this case, the organizer is entitled to carry out a substitute draw and then transfer the prize to another participant.
Only one prize per participant is possible.
If circumstances arise for which the organizer is not responsible, the respective participant who has won, must accept an appropriate substitute prize. Such circumstances for which we are not responsible are, in particular, those that lie with the sponsors of the prizes.
- Termination of the competition
The organizer reserves the right to prematurely terminate competitions in whole or in part at any time, irrespective of deadlines and without prior notice and without reason, or to change its course if it is not possible to guarantee a proper and scheduled execution of the competition for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons.
- Data protection
In order to participate in competitions, it is necessary to provide personal data (first and last name, e-mail and postal address, telephone number, date of birth). The participant must show that the personal information provided, in particular first name, surname, e-mail address, postal address and date of birth, is truthful and correct.
The organizer is responsible for the collection, processing and use of personal data of the participants. The organizer will only use the personal information of the participant as well as other personal data within the framework of statutory provisions of data protection law. The organizer points out that no personal data of the participant will be passed on to third parties without consent or made available to them for use.
An exception is the company, RBV Birkmann GmbH & CO. KG which is commissioned to carry out competitions, which must collect, store and use the data solely for the purpose of carrying out the competitions. This regulation is only necessary if the competition is not carried out by the organizer.
The organizer will only store, process and use the information to the extent that this is necessary for the implementation of the competition or if the participant has given consent.
In accordance with Art. 6 (1) (a) GDPR, the participant voluntarily agrees that the organizer may collect personal data (namely first name, last name, date of birth, contact details such as address, e-mail address, telephone number, mobile phone number) for advertising purposes (sending newsletters as well as information about the latest products by e-mail.
The personal data will not be passed on to third parties.
The personal data will be stored for as long as the organizer needs it for advertising purposes or until the participant's consent is revoked.
The participant is entitled to obtain information from the organizer about their personal data and to request its correction if the personal data is incorrect. Taking into account the purposes of the processing, the participant has the right to request the completion of incomplete personal data, including by means of a supplementary declaration.
The participant also has the right to information about the following details:
- The purposes of the processing (in this case, usually for advertising purposes);
- The categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations (the company commissioned to carry out the competition);
- The planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration;
- The existence of a right to rectification or erasure of personal data concerning the data subject to restriction of processing by the controller or a right to object to such processing;
- The existence of a right of appeal to a supervisory authority;
- If the personal data are not collected from the data subject, all available information on the origin of the data;
- The existence of automated decision-making, including profiling, in accordance with Article 22 (1) and (4) of the GDPR and, at least in these cases, meaningful information on the logic involved and the scope and intended effects of such processing on the data subject.
If personal data are transferred to a third country or to an international organisation, the data subject has the right to be informed of the appropriate safeguards pursuant to Art. 46 GDPR in connection with the transfer.
The controller shall provide a copy of the personal data that are the subject of the processing. For any further copies requested by the data subject, the controller may charge a reasonable fee based on administrative costs. If the data subject submits the request electronically, the information shall be provided in a commonly used electronic format, unless indicated otherwise. The right to receive a copy must not adversely affect the rights and freedoms of others.
The participant can revoke their declared consent at any time. The revocation is to be sent by telephone, fax, e-mail, on the homepage of the organizer or in writing to the organizer. After revocation of consent, the collected and stored personal data of the participant will be deleted immediately. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.
- Applicable law
Questions and complaints in connection with the competition should be addressed to the organizer.
The competition of the organizer is subject exclusively to the law of the Federal Republic of Germany. The judge’s decision is final.
- Severability clause
Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. In place of the invalid provision, the legally permissible provision that comes as close as possible to the meaning and purpose expressed in the invalid provision shall apply. The same applies in the event of a loophole in these conditions of participation.
